Terms of service

These terms are an agreement between you and Sphurava Technologies ("we", "us"), which operates LeadsGen at leadsgen.cloud. By creating an account or using LeadsGen, you accept these terms on behalf of yourself and the business you represent.

1. The service

LeadsGen collects enquiries for your business from sources you connect, such as your website, forms, WhatsApp, IndiaMART and Google Ads. It replies to them, asks qualifying questions using AI, and sends you the leads that are ready to buy. Features may change as we improve the service.

2. Your account

• You must be at least 18 and authorised to act for the business.
• The details you give us, including your business information and the claims you approve, must be accurate.
• You are responsible for everything done through your account and by the team members you invite. Keep sign-in access and API keys safe.

3. Pricing and the wallet

• You pay per genuine lead, from a prepaid wallet. The price depends on your type of business and is shown in your dashboard before you are charged.
• A lead is genuine when it came to you through LeadsGen, for example through your LeadsGen forms, pages, WhatsApp link, comment replies, or connected ads and marketplaces, and the person replied to the assistant or their conversation was handed to you. Any lead the assistant qualifies is also genuine, including leads you imported. Each lead is charged at most once.
• You are not charged for people who never reply, for anyone the assistant decides from their first message isn't a sales enquiry, for leads you import or add yourself unless the assistant qualifies them, or for conversations handed to you because of our limits or failures, such as an empty wallet.
• If the wallet balance doesn't cover the next lead, the AI pauses and hands new conversations to you until you top up.
• If WhatsApp wallet billing is on for your account, WhatsApp messages you start are charged to the wallet at Meta's rates plus a fee shown in your dashboard. Otherwise Meta bills you directly.
• Prices include applicable taxes. The wallet holds credit for LeadsGen services only. It earns no interest, can't be transferred, and can't be used anywhere else.
• When you close your account, you can ask for any unused balance to be refunded to the original payment method, after deducting charges already incurred.
• We may change prices with notice. A change applies only to leads qualified after it takes effect.

4. Disputes

If you believe a lead was charged in error, for example because it was spam, a duplicate or not genuine, you can dispute it from your dashboard. We review the full conversation and the reason it was charged. If we uphold the dispute, we credit the charge back to your wallet. Our decision after review is final for that charge.

5. Your responsibilities

• You must have a lawful basis, including consent where needed, to contact the people whose details you bring to LeadsGen. LeadsGen checks consent and contact hours before every message, but the data and the relationship with the people you contact are yours.
• You must follow the law and the rules of the channels you use, including India's Digital Personal Data Protection Act, 2023, TRAI regulations, WhatsApp's Business and Commerce policies, and the terms of IndiaMART, Google and any other source you connect.
• You must not use LeadsGen for spam, unsolicited bulk messages, misleading or unlawful offers, or anything that harms the people you contact.
• You must not try to break, overload, reverse engineer or get around the limits of the service.

6. AI-generated replies

Replies are written by AI from your business profile and the claims you approve. They can still be wrong or incomplete. You are responsible for the offers, prices and claims made to your customers, so review conversations and correct your profile when needed. You can take over any conversation at any time.

7. Data

You own your business data and your leads. You allow us to use them only to provide and improve the service for you, as described in our Privacy policy. For leads, we process personal data on your behalf and follow your instructions given through the service.

8. Third-party services

LeadsGen works with services we don't control, such as WhatsApp, Google, IndiaMART, Razorpay and your CRM. Their availability, rules and charges are set by them. We are not responsible if they change, suspend or limit your access.

9. Suspension and closing your account

You can stop using LeadsGen at any time. We may suspend or close an account that breaks these terms, puts others at risk, or remains unpaid. Where we reasonably can, we will tell you first and give you a chance to fix the problem. After closure you can ask us to export or delete your data.

10. Intellectual property

LeadsGen, its software and its brand belong to us. You get a limited right to use the service while your account is in good standing. If you send us feedback, we may use it without any obligation to you.

11. Warranties and liability

• We work to keep LeadsGen reliable, but it is provided "as is". We don't promise any particular number of leads, sales or results.
• To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost business or lost data.
• Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
• You will compensate us for losses caused by your breach of these terms or of the law, including claims from people you contacted through LeadsGen.

12. Changes to these terms

We may update these terms. If a change matters, we will tell you by email or in the dashboard before it takes effect. If you keep using LeadsGen after that, you accept the new terms.

13. Law and disputes

These terms are governed by the laws of India. Courts in Hyderabad, Telangana have exclusive jurisdiction.
